1. Agreement
These Terms of Service (“Terms”) govern your use of Offtape (the “Service”), provided by Offtape (“Offtape,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
2. What Offtape is
Offtape is a daily performance and accountability tracking tool. It lets you log daily inputs and an outcome, and it shows you patterns and correlations in your own data over time. Correlations and insights are illustrative observations derived from the data you log; they are not guarantees, predictions, or professional advice.
3. Not medical, mental-health, financial, or professional advice
This is important. Offtape is a self-tracking tool, not a medical device, healthcare service, mental-health service, or financial-advice service.
- Nothing in the Service is medical, psychological, therapeutic, or financial advice.
- The Service is not intended to diagnose, treat, cure, or prevent any condition.
- Correlations the Service shows are statistical observations from your own logged data and should not be relied on as professional guidance.
- Always consult a qualified professional (medical, mental-health, financial, or otherwise) for decisions in those domains. If you are experiencing a crisis, contact a qualified professional or local emergency services.
You are solely responsible for how you use the information the Service presents.
4. Your account
- You must provide accurate information and keep your password secure.
- You’re responsible for activity under your account.
- You must be at least 16 to use the Service.
- Notify us at info@offtape.io if you believe your account has been compromised.
5. Your content and your data
- You own the data you log — your metrics, outcomes, and journal entries. We claim no ownership of it.
- You grant us only the limited permission necessary to store, process, and display your data back to you in order to operate the Service.
- We handle your data as described in our Privacy Policy, including our commitments not to sell, share with advertisers, pool, or train AI models on your journal and logged data.
- You can export and delete your data at any time.
6. Acceptable use
Don’t:
- Use the Service unlawfully or to harm others.
- Attempt to breach, probe, or disrupt the Service’s security or other users’ data.
- Reverse-engineer, scrape, or abuse the Service or its infrastructure.
- Resell or commercially exploit the Service without our permission.
We may suspend or terminate accounts that violate these Terms.
7. Plans, pricing, and changes
- The Service currently offers a free tier and may offer paid tiers. Pricing and paid-tier terms — including billing, renewals, and refunds — will be added here when paid plans launch.
- We may modify, suspend, or discontinue features of the Service. We’ll give reasonable notice of material changes where we can.
8. Availability and “as is”
The Service is provided “as is” and “as available.” We work to keep it running and accurate, but we don’t guarantee it will be uninterrupted, error-free, or that any insight it shows is accurate or complete. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, Offtape will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars (US$100).
10. Termination
You can stop using and delete your account at any time. We may suspend or terminate your access if you violate these Terms. On termination, the data-deletion provisions of our Privacy Policy apply.
11. Changes to these Terms
We may update these Terms. When changes are material, we’ll update the “Last updated” date and, where appropriate, notify you. Continued use after changes means you accept them.
12. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida. This Florida governing-law clause does not remove our GDPR obligations toward EU/EEA users — see the Privacy Policy.
